These terms describe the responsibilities, limits, fees and service conditions that apply when using BisnesPOS.

Use of the platform
BisnesPOS provides software tools to manage business operations such as sales, invoices, appointments, orders, service workflows, inventory-related activity, customer records, reports and related operational tools. Each business is responsible for using the platform lawfully and for configuring its workspace, products, prices, taxes, fees, employees, customer communications and records in a way that matches its own legal and business obligations.
Account responsibility
Each business is responsible for account credentials, user access and permissions configured inside the workspace. You must keep login credentials secure and promptly remove access for unauthorized or inactive users.
Data entered by each business
Each business controls the records it enters, imports, uploads or creates in its workspace, including customer records, employee records, order history, invoices, services, appointments, documents, internal notes, communications and module-specific operational data. Businesses must only enter information they are authorized to process and should avoid placing unnecessary sensitive information in notes, descriptions, custom fields or support messages.
Privacy, security and confidential information
BisnesPOS uses reasonable safeguards intended to protect account and operational data, including access controls, authentication, tenant separation controls, audit records and selected encryption protections for sensitive workflows. These safeguards do not replace each business's responsibility to configure roles carefully, use strong passwords, maintain accurate employee access, protect devices and follow its own legal, privacy, payment and professional obligations. Do not submit passwords, full payment card data, government identifiers or confidential client information unless the specific feature is intended to receive that information.
Legal Services module
If the Legal Services module is enabled, the business is responsible for the legal records, case information, documents, identifiers, notes, reminders and access credentials entered by its authorized users. BisnesPOS provides operational software tools and does not provide legal advice, immigration advice, case strategy, professional representation or guarantees about legal outcomes. Businesses must use the module only with proper authority, keep user access limited to appropriate personnel, verify all records for accuracy, protect client confidentiality and comply with all professional, ethical, privacy and recordkeeping obligations that apply to their own practice or organization.
SMS, email and customer communications
The platform may include tools for transactional SMS, email or other customer communications such as appointment reminders, invoice notices, payment links, order updates, service updates and support follow-ups. Each business is responsible for collecting and documenting any consent required for its own communications, honoring opt-out requests, keeping contact information accurate and using messaging tools only for lawful, relationship-based purposes. Mobile opt-in information, phone numbers and SMS consent are not shared by BisnesPOS with third parties or affiliates for marketing or promotional purposes.
Plans, pricing and fees
Paid plans, module access, usage limits, optional add-ons, taxes and any applicable fees are shown before checkout or in the billing area of the platform. The price presented at checkout is the price you authorize for the selected plan or service, subject to later changes that are disclosed before they apply. Businesses should review the plan, billing period, included modules, limits, taxes and total amount before completing a purchase.
Automatic renewals and cancellation
Subscriptions may renew automatically for the billing period shown at checkout or in your billing area unless they are cancelled before the renewal date. By subscribing, you authorize recurring charges for the selected plan, modules, add-ons, taxes and applicable fees. You may request cancellation through the billing tools made available in the platform or by contacting support. Cancellation stops future renewal charges after the current paid period, unless the checkout, billing screen or written agreement states otherwise. We aim to make cancellation instructions clear and reasonably easy to complete.
Payment and refund policy
Fees are charged at checkout, at renewal, when a paid plan or module is activated, or when another paid service is authorized. Unless a checkout screen, billing screen, written agreement or applicable law says otherwise, subscription fees are non-refundable once a billing period begins, and cancellation does not automatically create a refund for the unused portion of a paid period. We may review refund or credit requests case by case, including duplicate charges, billing errors or service issues reported promptly.
Trials and plan changes
If a trial or promotional offer is provided, the offer will identify the trial period, what is included and whether payment is required to continue after the trial. Upgrades, downgrades and module changes may affect access, limits and billing. Some changes may take effect immediately, while others may apply at the next renewal or after payment provider confirmation. Nothing in these terms limits any non-waivable consumer protection rights that may apply.
Payment processing
Card payments and subscription payments may be processed by an authorized payment provider. By making or accepting card payments through the platform, you authorize the payment provider to process the transaction and understand that its own terms, security controls and network rules may apply. BisnesPOS may store limited payment information needed for receipts, reconciliation, account status and support, such as transaction identifiers, payment status, card brand and last four digits, but it is not intended to store full card numbers or card security codes.
Payment security and PCI-DSS
BisnesPOS is designed to use approved payment-provider flows for card entry, tokenization and processing so that sensitive card data is handled by the payment provider rather than by ordinary platform screens. Businesses must not enter full card numbers, security codes or other sensitive payment credentials into notes, messages, custom fields or support requests. We maintain reasonable safeguards for payment-related configuration and records, and businesses remain responsible for following payment card network rules, provider requirements and any PCI-DSS obligations that apply to their own environment.
Consumer protection and clear charges
We intend for plan charges, recurring billing, required fees, optional fees, cancellation instructions and material limitations to be presented clearly before a customer authorizes payment. Businesses using BisnesPOS must also clearly disclose their own prices, taxes, fees, refund policies, cancellation rules and customer-facing terms where required by law. The platform may provide tools to support these disclosures, but each business remains responsible for the accuracy of what it charges and communicates to its customers.
Live Auction sales fee
If a business uses the Live Auction module, BisnesPOS reserves the right to charge a platform fee equal to 3% of sales completed through Live Auctions. This fee may be charged, withheld, invoiced, offset, or otherwise collected through the payment or billing methods supported by the platform. Live Auction sellers remain responsible for their own product pricing, customer disclosures, taxes, fulfillment, refunds, chargebacks, and compliance obligations.
Data and availability
We aim to provide reliable service and reasonable security safeguards. Service interruptions, maintenance windows or third-party provider incidents may occasionally affect availability. Businesses should keep operational best practices and internal backups for critical workflows.
Data deletion requests
If a user or business wants personal information deleted from active systems, they may send a request to support@bisnespos.com including the account or business name, administrator email, associated phone number, relationship to the account and a clear description of the data requested for deletion. We will review the request, verify authority where appropriate and delete or anonymize eligible active information and associated files within a reasonable time, subject to legal, security, accounting, tax, payment, fraud-prevention, dispute-resolution, backup, technical and operational retention requirements. End customers of a business should first contact the business that collected or created the record when the business controls that information.
Backups, logs and retained records
Deletion from active systems does not always immediately remove information from backups, logs, security records or archival systems. Those copies may remain for a limited period and then expire through normal retention processes. Some records may be retained when required to comply with law, taxes, accounting, payment network rules, anti-fraud needs, dispute handling, chargebacks, security investigations or protection of the platform and its users.
Acceptable use
You may not use the platform for unlawful, fraudulent, deceptive, abusive or harmful activities. Prohibited activity includes fraud, money laundering, sanctions violations, illegal content, spam, phishing, malware, piracy, intellectual property infringement, attempts to bypass security controls, interference with system stability, misuse of payment, messaging or customer data features, or selling products or services prohibited by law, payment network rules or our payment providers.
Suspension and termination
We may suspend, restrict, freeze or terminate access to the platform, specific modules, accounts, users, payment features or customer-facing tools if we believe there is unlawful activity, security risk, non-payment, chargeback abuse, fraud risk, violation of these terms, violation of provider rules, risk to other users, or conduct that could create legal, financial or operational harm. When reasonable, we will provide notice and an opportunity to resolve the issue, but urgent risks may require immediate action.
Service provided as-is
The platform is provided on an as-is and as-available basis. We work to provide a reliable service, but we do not guarantee uninterrupted access, error-free operation, 100% uptime, compatibility with every device or browser, or that every third-party service will remain available. Businesses are responsible for reviewing their records, maintaining appropriate procedures and making operational decisions based on their own judgment.
Limitation of liability
To the maximum extent allowed by law, BisnesPOS and its owners, employees, contractors and providers are not responsible for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue, loss of business opportunity, loss of goodwill, data loss, interruption of operations or claims by third parties, even if we were advised that such damages were possible. Our total liability for claims related to the platform is limited to the amount paid to BisnesPOS for the service during the three months before the event giving rise to the claim, unless applicable law requires a different limit.
Arbitration agreement
By using the software, you agree that disputes, claims or controversies arising out of or relating to the platform, these terms, billing, subscriptions, payments, access or account activity will be resolved by binding individual arbitration instead of in court, except for matters that may be brought in small claims court or where applicable law does not allow arbitration. Arbitration will be conducted privately by a neutral arbitrator under commercially reasonable rules. The arbitrator may award individual relief allowed by law, but may not conduct a class, collective, consolidated or representative proceeding unless both sides agree in writing.
Class action waiver
By accepting these terms and using the software, you agree to bring claims only in your individual capacity and not as a plaintiff, class member or representative in any class action, collective action, consolidated action, private attorney general action or other representative proceeding. You waive the right to participate in a class action to the maximum extent allowed by law. If this class action waiver is found unenforceable for a particular claim, that claim may proceed only as required by applicable law and the rest of the dispute terms remain in effect where possible.
Limitation and updates
Features may evolve over time. We may update these terms, product capabilities, plan definitions, provider integrations or module availability as the platform grows. When changes materially affect pricing, renewals or core obligations, we will aim to provide reasonable notice through the platform, billing area, checkout flow, email or another appropriate channel. Continued use of the service after updates indicates acceptance of the current terms, except where additional consent is required by law.
Questions, disputes and legal rights
If you believe a charge, renewal, cancellation, refund, payment record or account action is incorrect, contact us promptly so we can review it. These terms are intended to be clear and fair, and they do not waive rights that cannot legally be waived under applicable consumer protection, payment card, privacy or state law.
